What Does the Law Say About Christmas Day Work in Malaysia?

Under the Employment Act 1955, Christmas Day is recognized as a public holiday in Malaysia. 

If an employee is required to work on this day, they are entitled to extra compensation. 

The law ensures that employees who sacrifice their holiday receive fair treatment and are adequately compensated for their time and effort.

It’s important to note that different pay calculations may apply depending on whether the employee is covered under the Employment Act or has a separate contractual agreement.

How to Calculate Pay for Working on Christmas Day in Malaysia

1. For Employees Covered by the Employment Act

If your employees fall under the Employment Act, their pay for working on Christmas Day should be calculated as follows:

  • Daily-rated employees: These employees must be paid triple their regular daily wages. This includes one day’s regular wage for the public holiday and twice the daily wage for working on the holiday.

  • Monthly-rated employees: If a monthly-paid employee works on Christmas Day, they should receive double their ordinary daily rate on top of their usual monthly salary.

2. For Employees Not Covered by the Employment Act

For employees earning above RM 4,000 or those in managerial positions, the rules in the Employment Act may not apply. 

In this case, refer to the employment contract or company policies to determine holiday pay. Many employers follow the same triple-pay guideline as a fair practice.

Examples of Christmas Pay Calculations

Let’s look at some practical examples:

1. Daily-rated employee earning RM 100 per day

  • Regular daily wage: RM 100

  • Additional pay for working on a public holiday: RM 200 (double the daily wage)

  • Total pay for the day: RM 300

2. Monthly-rated employee earning RM 3,000 per month

  • Daily wage (RM 3,000 ÷ 26 working days): RM 115.38

  • Additional pay for working on a public holiday: RM 230.76 (double the daily wage)

  • Total pay for the day: RM 346.14

Additional Considerations for Holiday Work

1. Substitute Holidays

If an employee agrees to work on Christmas Day, they may be offered a replacement holiday on another day. 

This substitute holiday must be mutually agreed upon and granted within 90 days of the original public holiday.

2. Overtime Pay

If an employee works beyond their standard hours on Christmas Day, they are entitled to overtime pay. 

Overtime for public holidays is calculated at three times the hourly rate.

How to Handle Christmas Day Pay for Shift Workers

For shift-based employees, ensure their schedules are clear about holiday pay entitlements. 

If the shift starts on Christmas Eve and continues into Christmas Day, the work hours that fall on Christmas Day should be calculated using the holiday pay rate.
