Company secretary firms can operate under Phase One and Two
Today, the Companies Commission of Malaysia (SSM) said that company secretary firms can now operate under Phase One & Two of the National Recovery Plan (NRP), subject to its approval.
In a statement, SSM said that the Ministry of International Trade and Industry (MITI) had agreed to list company secretary services under the professional and consulting services. This action enables company secretary firms to submit their application to operate to MITI for the purpose of carrying out secretarial services.
As the body that governs the company secretary under the Companies Act 2016, SSM said it had been given the responsibility as the approving body for operating permission applied by company secretary firms.
Hence, SSM said members of professional bodies approved under the Fourth Schedule of the Companies Act 2016 can send in applications for their secretarial firms if they wish to restart operations at their business premises.
Secretarial firms can submit their application through the Covid-19 Intelligent Management System (CIMS) website operated by MITI. MITI had also provided the user guide on how to apply at the portal.
Companies must comply with SOPs
SSM said company secretary firms that have gotten approval to operate under Phase One and Two of the NRP must comply with the conditions set by MITI and the National Security Council's (MKN) SOPs from time to time to stop the spread of Covid-19.
SSM added that it hoped with the reopening of the sector, company secretary firms could proceed to play a role in supporting the corporate sector, mainly involving small and medium-sized enterprises (SMEs) in reviving Malaysia's economy.
Applying at CIMS

Visit the MITI portal at www.miti.gov.my, click CIMS 3.0 icon and log in to CIMS 3.0 portal. You may need to sign up for a new account if you are a new user of CIMS. Otherwise, you can log in using your existing ID and password to continue your application or check its status.

The contact person as requested in CIMS should be the owner of the entity, any director/partner of the entity or any employee who is answerable for the registration and the company administration.

MITI will update all application status in CIMS 3.0. SSM will not issue any approval letter. MITI will issue the approval letter via the CIMS system, and you can download it through CIMS.
