
Government May Penalise Employers Who Force Staff to Come to Work

Hire NowThe National Security Council (MKN) is considering providing the labour department with the authority to take action against employers who violate the work from home ruling.
Human Resources Minister M Saravanan stated that under Act 342, only the Health Ministry has the authority to act against employers who do not follow the SOPs.
He said that the ministry had received several complaints about private companies still forcing their workers to come to the office to work. However, they were unable to take action.
He added that the technical committee had approved the proposal to have the health ministry delegate the authority to the labour department.
Saravanan stated that once approved by the MKN committee, the labour department will immediately take action on employers who ignored the work from home SOPs.
Heavy fine for violators
The minister was speaking to journalists after heading an operation to check on compliance with the Employees’ Minimum Standards of Housing, Accommodations and Amenities Act 1990 (Act 446) and movement control order 3.0 yesterday.
Saravanan added that the fine imposed would be RM50,000 for companies and RM10,000 for individuals who breached the work safety rules.
In an attempt to limit movement during MCO 3.0, the government had determined that 80% of public sector workers and 40% of the private sector staff will work from home.
This directive ensures that eight million people from both sectors would not have to go out to work during the MCO 3.0 period.
Currently, 40% of private sector workers are supposed to be working from home.
About the enforcement of Act 446
As of now, he explained that the government has never revoked the enforcement of Act 446. According to him, the government implemented the Act to ensure a high level of compliance by employers, which is notably more crucial now as Covid-19 transmission is increasing at an alarming rate.
Saravanan said that the Ministry of Human Resources would discuss with the Ministry of Science, Technology and Innovation on the best way to vaccinate workers, including foreign ones, in the manufacturing sector as workplace clusters had led to an increase in Covid-19 transmission.
“We are concerned over the huge number of undocumented workers, and we call on employers or those with information to report to us immediately so that action can be taken,” he stated.
