Workers in Malaysia may be eligible to claim PERKESO benefits when they take MC or cuti sakit due to a work-related accident or occupational disease.

Under Skim Bencana Pekerjaan, eligible workers can receive Faedah Hilang Upaya Sementara (FHUS) to help replace income during their certified medical leave.

The benefit pays 80% of the worker's average assumed daily wage, subject to the minimum and maximum payment rates.

However, not every MC or cuti sakit qualifies for a PERKESO claim. The injury or illness must meet the scheme's eligibility requirements.

Here is what you need to know about eligibility, payment rates, required documents and how to claim PERKESO for MC or cuti sakit.

Faedah Hilang Upaya Sementara (FHUS) is a benefit under Skim Bencana Pekerjaan, also known as the Employment Injury Scheme.

It provides financial support to eligible workers who are temporarily unable to work because of a qualifying work-related accident or occupational disease.

The benefit is paid during the period of medical leave certified by a doctor, subject to PERKESO's requirements.

The daily payment rates are:

Benefit Details Amount
Daily benefit rate 80% of the average assumed daily wage
Minimum daily payment RM30.00
Maximum daily payment RM158.67

The amount you receive depends on your average assumed daily wage and the number of eligible days of medical leave.

PERKESO does not pay FHUS for days when you attend work and receive wages.

For more information, visit PERKESO's official Skim Bencana Pekerjaan page.

What Are the Requirements to Claim PERKESO for MC?

To qualify for Faedah Hilang Upaya Sementara, you must meet the eligibility conditions described in eCentral's guide.

Your Accident or Illness Must Be Related to Work

Your MC must be caused by a qualifying work-related accident, commuting accident or Penyakit Khidmat, which refers to an occupational disease caused by your working environment.

Examples include:

  • Getting injured while carrying out your work duties.

  • Being involved in an accident while travelling between home and your workplace on an eligible journey.

  • Developing an occupational disease because of exposure to chemicals or other workplace hazards.

An ordinary illness unrelated to work, such as a common fever or toothache, does not automatically qualify for FHUS under Skim Bencana Pekerjaan.

Your MC Must Be at Least Four Consecutive Days

Your certified medical leave must be at least four consecutive days, including the day the accident happens.

If your MC is shorter than four consecutive days, you do not meet the minimum requirement stated in eCentral's guide.

You Must Not Work During the Eligible MC Period

You must not attend work or perform work duties during the relevant certified medical leave period.

PERKESO does not pay FHUS for days when you attend work and receive wages.

You Must Meet the Age and Contribution Conditions

eCentral's eligibility list specifies workers below 60 years old with active contributions under Skim Bencana Pekerjaan.

Your eligibility depends on your coverage and contribution status. You can check your individual circumstances with PERKESO before submitting your claim.

What Documents Are Needed to Claim PERKESO?

Prepare the relevant documents before submitting your claim.

Documents for an Accident at the Workplace

According to eCentral's guide, the required documents include:

  1. Kad Pengenalan: One copy of your identification card.

  2. MC Original: The original medical certificate or sijil cuti sakit.

  3. Punch Card or Attendance Record: One copy as proof of attendance.

  4. Payslips: Copies of your six months of payslips before the accident.

  5. Initial Treatment Memo: One copy of the memo from the clinic or hospital where you first received treatment.

PERKESO may require additional supporting documents depending on the type of accident and claim.

Additional Documents for a Road Accident

For a road accident, prepare the documents listed above, together with:

  1. Laporan Polis: The police report for the road accident.

  2. Peta Lakar: A hand-drawn map on A4 paper showing the road names, workplace, accident location and home address.

Check the latest Borang 34 checklist to confirm the documents required for your claim.

What Types of Accidents Can Be Claimed Under PERKESO?

eCentral's guide describes several types of accidents that may qualify for PERKESO benefits.

1. Accidents While Performing Work Duties

These are accidents that happen at the workplace or while carrying out work-related duties.

For example, a worker who falls and gets injured at the office or is injured while delivering products for the company may qualify, subject to PERKESO's assessment.

2. Accidents While Travelling

Certain accidents during eligible journeys may qualify, including accidents that happen while:

  • Travelling between your home and workplace.

  • Travelling for a purpose directly related to your employment.

  • Travelling between your workplace and a place to eat during an authorised rest break.

For example, if you are involved in a road accident while travelling to work, you may qualify if the journey meets PERKESO's requirements.

3. Accidents During an Emergency

This category covers qualifying accidents that happen when you are at or near your workplace while helping, rescuing or protecting someone facing danger during an emergency.

For example, a worker who gets injured while helping a colleague during a fire may qualify, subject to the scheme's conditions.

4. Accidents Outside Working Hours Under Skim LINDUNG 24 JAM

Skim LINDUNG 24 JAM provides protection against certain personal accidents that happen outside working hours and are not directly related to employment.

eCentral explains that eligible workers, including workers covered under the relevant domestic-worker arrangements, may also receive this protection. Coverage depends on the applicable participation and contribution requirements.

Examples of accidents that may qualify include:

  • Kemalangan domestik: An accidental fall down the stairs at home.

  • Accidents during recreational activities: Injuries while playing sports, going on holiday or shopping.

This scheme covers qualifying accidents rather than ordinary illnesses such as fever or high blood pressure.

Method 2: Submit Your Claim Through Your Company's HR Department

You can also ask your employer's HR department for assistance.

Can You Claim PERKESO If Your Employer Still Pays Your Full Salary?

According to eCentral, workers may not receive Faedah Hilang Upaya Sementara (FHUS) for a period when their employer continues to pay their full salary.

The article also explains the principle of “Tiada Double Claim”, which means avoiding duplicate compensation for the same period. Where full salary has already been paid, the employer may seek recovery of a benefit payment made for that same period.

PERKESO's official guidance specifically states that FHUS is not payable for days when a worker attends work and receives wages. The treatment of full salary paid during certified medical leave should be confirmed directly with PERKESO, as the circumstances may differ.

The following situations are important to understand:

  • If your employer pays your full salary: Check with your employer and PERKESO how the salary payment affects FHUS for the same period.

  • If you take unpaid leave: If your salary is deducted during the MC period, you may qualify for FHUS, subject to the eligibility and claim requirements.

  • If you return to work: PERKESO does not pay FHUS for days when you work and receive wages.

FHUS is intended to replace income lost during eligible medical leave. Confirm your entitlement before assuming that you can receive the benefit in addition to your full salary.
