Salary and Pay Rules If Employees Work on Raya Haji
This is one of the most important parts for HR teams and employers.
If employees are required to work on Hari Raya Haji, employers must follow the payment rules under the Employment Act 1955.
Hari Raya Haji is a gazetted public holiday in Malaysia, and employees are generally entitled to paid public holiday benefits under the Employment Act 1955.
Employees on Monthly Salary
If an employee works on Hari Raya Haji, they are entitled to:
-
Their normal daily wage
-
An additional two days’ wages at the ordinary rate of pay
In simple terms, employees who work during the public holiday are usually entitled to payment equivalent to three times (3x) their ordinary daily rate.
For example, if an employee’s daily salary is RM100, they may receive RM300 in total for working on Hari Raya Haji.
Employees on Daily or Hourly Rate
The same principle applies to employees paid daily or hourly.
They are entitled to:
-
Their normal public holiday pay
-
Two additional days’ wages for work performed on the public holiday
This is why many HR and payroll teams double-check payroll calculations during festive seasons to avoid underpayment issues.
If Hari Raya Haji Falls on a Rest Day
If the public holiday falls on an employee’s rest day, the next working day is usually treated as a substituted public holiday.
If the employee works on that substituted holiday, the same public holiday payment rules apply.
What Happens If Employers Do Not Pay Correctly?
Failure to comply with public holiday payment regulations under the Employment Act 1955 may expose employers to penalties and non-compliance issues.
To avoid payroll disputes and employee complaints, employers should ensure public holiday salary calculations are processed correctly before payroll closing dates.
