Former HR Executive Convicted of Falsifying Salary Claims

Yesterday, the Sessions Court in Ipoh sentenced a former human resource executive of a pharmaceutical firm to two months in jail and a fine of RM79,900.95 for making false salary claims. 

The 31-year-old pled guilty to five out of her 14 charges read before judge S. Indra Nehru. For every charge, the judge sentenced the accused to two months in jail. She also said the accused will serve the jail sentence concurrently.

According to Indra Nehru, the accused will be jailed for 15 months in default of the fine. The accused was previously on the run. 

The Malaysian Anti-Corruption Commission (MACC) deputy public prosecutor Nurul Wahida Jalaluddin represented the prosecution while lawyer Mohd Mohd Redzuan Mohamed Yusoff represented the accused. 

The prosecutor later said that the accused was discharged and acquitted of the other nine charges under Section 171 (A) of the Criminal Procedure Code (CPC). The CPC section allows the courts to account for an existing conviction when considering any outstanding charges against the accused. 


The accused was convicted of falsifying salary claims.

The accused was charged under Section 18 of the MACC Act 2009, which carries a jail sentence of 20 years maximum and a fine of not less than five times the bribe value, RM10,000 or whichever is higher upon conviction. 

Based on the charge sheet, the accused and her husband had deceived a local pharmaceutical company by submitting documents that contained false information. 

The accused had claimed the salary of resigned workers from the firm totalling RM70,177.10. She provided her bank account number to the firm between June 2018 and December 2019. 

The husband was also charged with 25 counts of abetting the accused in making the false salary claims but pled not guilty. At that time, the accused was still on the run from the law. 

 

Former assistant health officer fined for false OT claims

In February, the Sessions Court in Kuala Lumpur fined a man RM12,500 for fraudulently using documents to claim over RM3,000 in overtime pay. 

The former assistant health officer pleaded guilty before judge Rozina Ayob. 

He admitted to five counts of fraudulently using the documents to claim RM644.63, RM709.09, RM547.93, RM966.94 and RM483.47 at the Health Ministry's salary unit office in Putrajaya between June 1 and October 1, 2015. The total amount for the five consecutive months was RM3,352.06.

Under the Penal Code's Section 471, the charge carries imprisonment of up to two years or a fine or both upon conviction.

Deputy public prosecutor Abd Muntaqim Abdul Aziz represented the prosecution while Mohd Johan represented the accused. The court fined the accused RM2,500 for each charge and ordered him to serve 15 months in jail if he fails to pay the fine. 

The accused paid the fine.
